Your order for purchase constitutes your “offer” which shall be subject to the terms and conditions as listed below. {www.coocuddle.in} the website has the right to accept or reject your offer without assigning any reason thereof.

In order to use the www.coocuddle.in website belonging to Coocuddle Fashions Private Ltd, you (The User) have accepted the following terms and conditions given below. reserves the right to add, delete, alter or modify these terms and conditions at any time.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

1. We have made every effort to display the colour of our products that appear on the site as accurately as possible. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of colour will be accurate. Coocuddle Fashions Private Ltd attempts to be as accurate as possible in the description of the product on the Platform. The Site may contain typographical errors or inaccuracies and may not be complete or current. The product pictures are indicative and may not match the actual product.

2. This Site is directed to be used by adults only (18+ years). We assume that any minor, if at all, accessing our Site is under the supervision of their guardians. Coocuddle Fashions Private Ltd or its associates do not knowingly collect information from minors. You will be responsible for maintaining confidentiality of your account, password, and restricting access to your computer, and you hereby accept responsibility for all activities that occur under your account and password. 

3. Coocuddle Fashions Private Ltd will not be responsible for any damage suffered by users from use of the services on www. coocuddle.in. This without limitation includes loss of revenue or data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act/omission of the vendor. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, negligence, defect, deletion, error, omission, interruption, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, or under any other cause of action.

4. Coocuddle Fashions Private Ltd will take “Full Responsibility” of your Order if the Order has been shipped to any of the major cities, where we used “Private Courier Companies”. Prior to making payments on the Platforms for the purchase of Products, the User will be prompted to provide a shipping address. While entering shipping address details, the User should ensure to provide correct, complete and accurate information along with sufficient landmarks in order to aid identification of the address. Any failure in delivering the purchased Products arising out of the User’s failure to provide correct, complete and accurate information shall not hold Coocuddle Fashions Private Ltd. liable at any point in time.

A maximum of 2 (Two) attempts shall be made to deliver purchased Products to the User. Should the User continue to remain unavailable after 2 (two) attempts, Coocuddle Fashions Private Ltd. reserves the right to cancel the order pertaining to the purchased Products at its sole discretion. While Coocuddle Fashions Private Ltd. shall make reasonable endeavours in ensuring that purchased Products are delivered to its Users in a timely manner, delivery may be delayed on account of weather, political reasons, acts of god, and other unforeseen reason.

5. The prices and availability of products are subject to change without prior notice at the sole discretion of Coocuddle Fashions Private Ltd

6. Request for cancellations of orders once placed on {www.coocuddle.in} shall not be entertained.

7. Coocuddle Fashions Private Ltd reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment been received. The payment shall be refunded and the User shall be informed of the same.

8. If a non-delivery or late delivery occurs due to a mistake by the User (i.e. wrong or incomplete name or address or recipient not available). Any extra cost spent by << Coocuddle Fashions Private Ltd >>for re-delivery shall be claimed from the User placing the order.

9. The User agrees to give accurate, authentic and true information. { Coocuddle Fashions Private Ltd } reserves the right to confirm and validate the information and other details provided by the User at any point of time. If any such User details are found not to be true wholly or partly, { Coocuddle Fashions Private Ltd } has the right in its sole discretion to reject the registration and debar the User from using the services of {www.coocuddle.in} without prior intimation whatsoever.

10. The Company and/or the Platform shall have a right to include a minimum order value at any time at is sole discretion, the same shall be notified to you via the Platform itself. aCredit card details provided by you for availing of services on the Site will be correct, accurate and current. Under no circumstances you shall use a credit card which is not lawfully owned by you. The card details will not be utilized and shared by Us with any of the third parties unless required for fraud verifications or by law, regulation or court order. We will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to ‘prove it otherwise’ shall be exclusively on you.

• • While availing any of the payment method/s offered by Us, We are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you out of the decline due to:

• • lack of authorization for any transaction/s; or

• • or exceeding the present limit mutually agreed by you and between your “Bank/s”; or

• • any payment issues arising out of the transaction; or

• • decline of transaction for any other reason/s.

In case of fraudulent use of the site, We reserve the right to recover the cost of goods, collection charges and lawyers fees from person(s) concerned. We reserve the right to initiate legal proceedings against such person(s) for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.

11. Company reserves the right to place advertisements and publicity materials of its choice, including that pertaining to third parties for commercial use on the Platform.

12. { Coocuddle Fashions Private Ltd. } shall not entertain any complaints after 7 days, once the order is delivered.

13. Coocuddle Fashions Private Ltd. strives to provide accurate product and pricing information, however errors may occur. Coocuddle Fashions Private Ltd. cannot confirm the price of the product until you make the order. If a product / service is listed at an incorrect price or with incorrect information due to any technical error, Coocuddle Fashions Private Ltd. shall have the right, at its sole discretion, to refuse or cancel any orders placed for that product/ service, unless the product has already been delivered or the service has already been availed by you. In the event, any kind of fraudulent activity is detected, Coocuddle Fashions Private Ltd. can recover its dues, if any, from User’s successive orders. In the event that an item is wrongly priced, Coocuddle Fashions Private Ltd. may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been delivered and the services are availed, your offer will not be deemed accepted and Coocuddle Fashions Private Ltd. will have the right to modify the price of the product/ service and contact you for further instructions using the e-mail address provided by you during the time of registration or placing of order, or cancel the order and notify you of such cancellation.

12. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Madhya Pradesh
